Distribution Restrictions for Computer Knowledge Shareware Programs
+=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=+
The restrictions outlined in this file apply to any person or group,
either for-profit or non-profit, seeking to distribute any Computer
Knowledge shareware product by any means.
+---------------------------------------------------------------------------+
1. In all cases, you may NOT distribute Computer Knowledge shareware
products if you advertise them as "free" or imply in any way that the
user has no further obligation to pay a fee to Computer Knowledge
or contact Computer Knowledge per the user license associated with
the specific program.
It is important that you attempt to distribute the very latest version
of any Computer Knowledge shareware product. The latest version may be
obtained from one of the sources listed at the end of this file.
You are free to use or modify file descriptions found in the file
DESCRIBE.TXT that accompanies each Computer Knowledge shareware program,
but you may NOT change the name of the program(s) you distribute.
Distributors may NOT add to any file associated with a Computer Knowledge
shareware product (including the EXE, DOC, README, or other files). Any
advertising material or other information must be placed in a separate
file and identified so the user may delete it if they desire.
Under no condition will the program be "rented" or leased to others.
Printed copies of program screens may not be distributed in any form
without a license from Computer Knowledge.
If instructed by Computer Knowledge to stop distribution of any
Computer Knowledge shareware program, you must immediately comply.
2. Free distribution, Non-profit organizations, and BBS distribution
If you charge no distribution fee, are a non-profit organization,
or BBS that makes no charge over and above standard connect time,
you may distribute Computer Knowledge shareware products subject to
the main restrictions in section (1) above. Others, please see the
next sections for additional restrictions.
3. For-profit distribution of any kind
For-profit distributors must make an extra effort to educate their
buyers about the nature of shareware and the fact that the buyer has
the obligation to obey the user license found with the program. This
includes instructions that the license may require additional payment
by the buyer.
ASP-Approved Vendors comply with these distribution requirements by
virtue of the requirements imposed upon them by the Association of
Shareware Professionals.
Non-ASP-approved vendors may distribute Computer Knowledge shareware
products so long as the nature of shareware is clearly explained.
Computer Knowledge suggests non-ASP-approved vendors adopt some or
all of the ASP methods of educating users:
- Vendor advertisements and brochures should state that "Shareware
programs require separate payment to authors if found useful."
- The following points should be covered in any catalog of disks:
= The fee paid to the vendor is a distribution charge and does not
cover the cost of the program itself.
= If the user finds a shareware program to be of use, he/she is
expected to register with the author and that this may require
additional payment to the author.
= Registration entitles the user to various rights and benefits
(depending on the author).
In no case shall any for-profit organization distribute Computer
Knowledge shareware if they fail to educate their customers about the
nature of shareware.
4. Special cases.
U.S. Government Information: Use, duplication, or disclosure by the
U.S. Government of the computer software and documentation associated
with Computer Knowledge shareware programs shall be subject to the
restricted rights applicable to commercial computer software as set
forth in subdivision (b)(3)(ii) of the Rights in Technical Data and
Computer Software clause at 252.227-7013 (DFARS 52.227-7013). The
Contractor/manufacturer is: Computer Knowledge, PO Box 91176, Los
Angeles, CA 90009-1176.
Consultants: Consultants are considered "for profit" distributors
and must abide by the restrictions in sections (1) and (3) above if
they do not register the software for their customer. Computer
Knowledge prefers that consultants who install Computer Knowledge
shareware products for customers complete the registration process
for the customer. Registration should be in the customer's name, not
in the name of the consultant.
Hardware vendors: Hardware vendors may NOT automatically place
Computer Knowledge shareware products onto hard disks sold with their
equipment. Since it is unlikely that the shareware concept will be
adequately explained in this circumstance, a special license from
Computer Knowledge is required for such distribution. Please contact
Computer Knowledge for information.
Bundling: Computer Knowledge shareware products may not be bundled
for sale with any commercial product without a license from Computer
Knowledge. Please contact us for information.
CD-ROM or similar collection: Sections (1) and (3) above apply. The
nature of shareware must be clearly explained using a method that makes
it easy for the user to read that information. In addition, the
collection must have some clear indication of its age so users have
the ability to determine if the software in the collection may be out
of date.
5. If there is any question about your ability to distribute Computer
Knowledge shareware programs, please contact Computer Knowledge for
guidance. Please explain the situation in detail.

Applying for ASP Associate Membership
+---------------------------------------+
If you would like to apply for ASP Associate Membership (Vendor and BBS
memberships are presently [1991] available), simply write to the
following address and request the appropriate membership application
package:
ASP Executive Director
545 Grover Road
Muskegon, MI 49442-9427
or send a CompuServe message via CompuServe MAIL to ASP Executive
Director 72050,1433. You may also FAX a request to the ASP Executive
Director at (616) 788-2765.
+------------------------------+
Obtaining the latest version
+------------------------------+
Each version of a Computer Knowledge shareware program is release
dated. If the version is over a year old it may not be the latest
version.
Computer Knowledge sends the latest program versions to all ASP-approved
vendors. Not all such vendors carry all ASP-member programs however.
Generally, Computer Knowledge has had good luck having programs placed
into the catalogs of the following two vendors:
Public Brand Software Public (Software) Library
PO Box 51315 PO Box 35705
Indianapolis, IN 46251 Houston, TX 77235-5705
(317) 856-7571 (713) 665-7017
Computer Knowledge also maintains current versions in the IBMNET
libraries of CompuServe. To find our programs please GO IBMFF to
access the file finder program and then search for the keyword CKPGM.
That keyword is common to all Computer Knowledge program keyword
sequences (Note: it would be rare, but others might possibly use the
sequence, so we also recommend that you view the entire file
description before downloading the file).
If you have questions or comments, please contact us at:
